Welcome to Pro Formance CRE, a tool designed to streamline the underwriting process for multifamily deals. This Privacy Policy explains how we collect, use, and protect your information when you use our website and services, including during trial periods. By using our Service, you agree to the practices described in this policy.

1. WEBSITE & COMMERCE (SQUARESPACE)

Visitors
This website is hosted by Squarespace. Squarespace collects personal data when you visit this website, including:

  • Information about your browser, network, and device

  • Web pages you visited prior to coming to this website

  • Web pages you view while on this website

  • Your IP address

Squarespace needs this data to run the website and protect/improve its platform and services. Squarespace analyzes the data in a de-personalized form.

Form Submissions
When you submit information via a webform, we collect the data requested in order to track and respond to your submission. We share this information with Squarespace, our hosting provider, to provide services to us.

Emails
We may send you transactional and marketing emails. You can unsubscribe from marketing emails using the link provided. Certain transactional messages (e.g., order confirmations, account updates, service notices) are mandatory.

Purchases and Personal Data
When you buy something on our website, we collect personal information to fulfill the order. This may include:

2. INFORMATION WE COLLECT THROUGH THE SERVICE

When you use the Pro Formance CRE Excel Add-in or Web Platform, we may collect:

  • Authentication Information: Email address and password to create and authenticate your account.

  • Account Metadata: Subscription details, license counts, trial status, feature usage logs, and related activity.

  • IP Address: Temporarily collected for session security and fraud prevention.

  • Deal Data (Folders and Deal Rooms): Deal-related data (Excel models, PDFs, Rent Rolls) you upload or save within the Service is stored on our servers. Sensitive deal data is encrypted at rest and is not human-readable by us. Metadata such as folder or deal room names may be stored in a human-readable format to support functionality.

  • Collaborative Data: If you subscribe to the "Director" plan and utilize Cloud Deal Rooms, we process the permissions and sharing logs required to connect your data with your invited team members.

3. HOW WE USE YOUR INFORMATION

We use collected information to:

  • Provide and authenticate access to the Service.

  • Store, process, and encrypt deal data you choose to save in Deal Rooms.

  • Enable collaboration between users you explicitly invite to a Deal Room.

  • Maintain the security and performance of the Service.

  • Improve and develop features based on usage patterns.

  • Fulfill purchases, subscriptions, and account management.

  • Enforce our Terms of Service, including restrictions around trial use and storage.

4. AI AND AUTOMATED PROCESSING

Generative AI Features
Certain plans ("The Associate" and "The Director") include features that utilize Generative AI and Large Language Models (LLMs) to generate text, research reports, or parse complex documents.

  • Data Transmission: When you use these specific features, the relevant input data (e.g., a property address or a T-12 PDF) is transmitted to our third-party AI partners (e.g., OpenAI, Google Cloud Vertex AI) for processing.

  • No Training on Your Data: We utilize enterprise-grade APIs that do not use your submitted data to train their public models. Your deal data remains confidential to your session.

  • Retention: AI inputs and outputs are retained temporarily to generate the response and for debugging purposes, but are not permanently stored by the AI provider.

Google Cloud Vision (OCR)
If you use the Rent Roll or T-12 scanning features, submitted documents are processed by Google Cloud Vision for Optical Character Recognition (OCR). These documents are processed in memory and are not retained by Google for training purposes.

5. DATA SECURITY

We implement commercially reasonable security measures, including:

  • Encryption in transit using Transport Layer Security (TLS).

  • Encryption at rest using Google Cloud Key Management Service (KMS).

  • Access controls and logging to prevent unauthorized access.

Important Disclaimer: No method of transmission or storage is 100% secure. While we use industry-standard measures, we cannot guarantee absolute security.

6. DATA RESTORATION AND RETENTION

Local Dependencies
The restoration of saved deals depends on your local environment, including your computer, Microsoft Excel, and related third-party systems. While we make commercially reasonable efforts to support restoration, we cannot guarantee successful restoration in every case. You are strongly encouraged to maintain local backups of all critical deal data.

Trial Periods
During any free or trial period, deal data saved in Deal Rooms or elsewhere on our servers may be subject to limitations, including storage capacity, retention time, or restoration availability. We reserve the right to delete or purge trial-period data at our discretion and without notice after the trial period ends.

7. DISCLOSURE OF INFORMATION

We do not sell or lease your personal or deal data. Information may be disclosed:

  • To trusted third-party sub-processors (Squarespace, Stripe, Google Cloud, and AI API providers) strictly as needed to deliver the Service.

  • To other users specifically authorized by you (e.g., if you invite a user to a shared Deal Room).

  • To comply with legal obligations or valid requests by public authorities.

  • To protect the rights, property, or safety of Pro Formance CRE, our users, or others.

8. YOUR RIGHTS AND CHOICES

Depending on your location, you may have rights regarding your personal data, including:

  • Access and Portability: The right to request a copy of the data we hold about you.

  • Correction: The right to correct inaccurate personal data.

  • Deletion: The right to request deletion of your account and associated data (subject to our legal retention obligations).
