1. NO FINANCIAL OR INVESTMENT ADVICE
Pro Formance CRE (“The Service”) is a technical tool designed to assist real estate professionals in data processing, visualization, and financial modeling. The Service, its output, and any associated materials do not constitute financial, investment, legal, or tax advice.

You acknowledge that:

  • Pro Formance CRE is not a registered investment advisor, broker-dealer, or financial analyst.

  • The Service is a tool for calculation and formatting; it does not "approve" or "validate" the economic viability of any real estate transaction.

  • You are solely responsible for verifying the accuracy of all inputs, assumptions, and outputs generated by the Service before using them for investment decisions, loan applications, or presentations to investors.

2. AI AND DATA ACCURACY DISCLAIMER
The Service utilizes Artificial Intelligence (AI) and Large Language Models (LLMs) to parse documents (Rent Rolls, T-12s) and generate text.

  • Probabilistic Nature: AI models are probabilistic, not deterministic. They may hallucinate, misinterpret headers, or incorrectly categorize expenses.

  • Verification Required: You must manually review and verify all data parsed or generated by the AI. Pro Formance CRE assumes no liability for errors in data extraction (e.g., a "Repair" expense incorrectly categorized as "Capital Expenditure") that affect your Net Operating Income (NOI) or valuation models.

3. SOFTWARE-AS-A-TOOL
The Service is provided to assist you, not to replace your professional judgment. Pro Formance CRE is not responsible for any financial losses, lost profits, or missed opportunities resulting from the use of, or reliance upon, the data generated by the Service.

4. THIRD-PARTY DATA
The Service may interact with or import data from third-party sources (e.g., uploaded PDFs, Excel files). We do not verify the accuracy of third-party data and are not responsible for the content of files you upload to the Service.

5. RELATIONSHIP TO AGREEMENTS
These Disclosures are incorporated by reference into the Pro Formance CRE Terms of Service and End-User License Agreement (EULA). In the event of a conflict between this Disclaimer and the Terms of Service, the Terms of Service shall govern.
